BeyondMed does not own, manufacture, or directly control the products listed on the platform. The marketplace serves as a venue for third-party vendors to list and sell products directly to buyers and is not involved in the manufacturing, testing, or certification of these products.
- Vendor Responsibility: Vendors are solely responsible for ensuring their products meet regulatory standards, are accurately represented in listings, and comply with all relevant laws.
- Buyer Responsibility: Buyers are responsible for ensuring that the products they purchase are suitable for their intended use and meet regulatory standards in their region.
2. Product Quality and Compliance Liability
- Vendor Accountability: Vendors are accountable for the quality, safety, and compliance of their products. They must ensure that all listings are accurate, complete, and comply with relevant laws and regulations, including but not limited to FDA, CE, or other regional certifications for medical equipment.
- Marketplace Disclaimer:BeyondMed does not provide any guarantees or warranties on product quality, safety, or compliance. Any issues arising from product performance, defects, or compliance fall under the vendor’s responsibility.
3. Limitation of Marketplace Liability
To the fullest extent permitted by law, BeyondMed disclaims all liability for direct, indirect, incidental, or consequential damages related to transactions facilitated through the platform. This includes, but is not limited to:
- Product Defects or Malfunctions: The marketplace is not liable for any damages arising from product defects, malfunctions, or failures.
- Regulatory Non-Compliance: Vendors are solely responsible for ensuring their products comply with relevant regulatory requirements. The marketplace is not liable for any claims or damages arising from non-compliant products.

4. Dispute Resolution and Buyer Protection

5. Indemnification
By using BeyondMed, vendors and buyers agree to indemnify and hold harmless BeyondMed, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or related to:
- Any product-related claims, including but not limited to claims for injury, illness, or damages resulting from product use.
- Breaches of regulatory compliance or misrepresentation of product information by vendors.

7. Vendor and Buyer Acknowledgement of Liability Terms
By listing products or making purchases on BeyondMed, both vendors and buyers acknowledge that:
